Summary (not a substitute for the full Terms): Greater Cater is a technology platform that helps connect buyers (Customers) and sellers (Restaurants). We do not sell food, employ Restaurants, or guarantee that any business is licensed, permitted, or compliant with local law. Restaurants are independent sellers responsible for their operations; Customers should satisfy themselves before ordering. By using the website or creating an account, you agree to these Terms.

Important: These Terms include an arbitration agreement and a class action waiver. Please read Section 16.

2. Eligibility and age requirements

You must be at least 18 years old (or the age of majority where you live, whichever is higher) to create an account or place a Pay Online order. If you are under 18, you may browse only with a parent/guardian’s supervision and may not place orders.

3. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to promptly update it if it changes.

4. Platform role; no guarantees about businesses

Greater Cater provides an online marketplace and related tools so Customers and Restaurants can discover each other, communicate, and complete transactions. Greater Cater is not the seller of food or goods listed on the platform, is not a party to the sale between a Customer and a Restaurant, and does not take title to items sold.

We do not guarantee, endorse, or warrant any Restaurant, menu item, listing, rating, permit status, food safety practice, price, availability, or outcome of any order. Any descriptions, photos, jurisdiction or compliance hints, or other information shown on the platform may be supplied by Restaurants or derived from third-party or administrative data and are provided for convenience only. They are not legal advice and do not mean Greater Cater has verified that a Restaurant is licensed, inspected, insured, or allowed to operate.

4.1 Restaurant (seller) responsibilities

Restaurants are independent third-party sellers, not employees, agents, or partners of Greater Cater. Each Restaurant is solely responsible for:

By using the Services as a Restaurant, you represent that your listings are accurate and that you—not Greater Cater—are responsible for compliance with all laws, regulations, and health-department rules that apply to you. You agree to indemnify Greater Cater for claims arising from your operations, except where prohibited by law.

4.2 Customer (buyer) responsibilities

Customers buy directly from the Restaurant they select. Before placing an order—especially from a home-based or lesser-known seller—you should use your own judgment. Greater Cater does not verify permits or backgrounds. You are responsible for deciding whether to trust a seller, including confirming any permits, insurance, or business registration you require, asking about allergens, and following safe food-handling practices after pickup or delivery.

5. Orders

When you place an order, you are making a purchase from the Restaurant. Order availability, fulfillment times, and substitutions are determined by the Restaurant. You agree to pay the total shown at checkout (including taxes, platform fees, delivery fees, and tips if applicable).

5.1 Home-based businesses

For customers: If you are ordering food from a home business, please order only if you know the person you are ordering food from. Do not place orders with people you don’t know.

For businesses: Do not accept orders from strangers if you are a home business.

6. Pay Online and payment processing

Pay Online is processed using third-party payment processors (for example, Stripe or Razorpay depending on the country and setup). Greater Cater does not store full payment card details. Your payment may be subject to the processor’s terms and privacy policies.

You authorize us and/or our processors to charge your payment method for the order total and applicable fees. If a charge fails, the Restaurant may cancel the order.

7. Platform fees, subscriptions, and trials (Restaurants)

Restaurants may be required to subscribe to Greater Cater features (e.g., a monthly or annual subscription) and may be subject to platform fees on certain order types. Pricing, currency, and fee structure may vary by business country and are shown in the onboarding and/or admin setup flows.

Subscriptions may include a free trial period if shown. Unless otherwise stated, subscription fees are non-refundable once billed, except where required by law.

8. Cancellations, refunds, disputes

Refund decisions are primarily handled by the Restaurant, subject to applicable law and payment processor rules. If you believe there is an issue with your order, contact the Restaurant first. If the issue cannot be resolved, you may contact Greater Cater support and we will attempt to help coordinate, but we do not guarantee outcomes.

10. Content and feedback

You retain ownership of content you submit (e.g., reviews if enabled), but you grant Greater Cater a license to host, display, and use that content to operate and improve the Services. Feedback may be used without restriction.

11. Intellectual property

The Services and all related software, branding, and content (excluding Restaurant content) are owned by Greater Cater or its licensors and are protected by intellectual property laws. You may not copy, modify, or distribute our materials except as permitted by law.

Restaurant content © respective owners: Menus, item descriptions, photographs, trade names, and other materials Restaurants publish on the platform belong to those Restaurants (or their licensors), not Greater Cater, except for the limited rights needed to host and display Restaurant content as part of operating the Services.

12. Privacy

Our privacy practices are described in our Privacy Policy. If you operate a Restaurant, you are responsible for your own privacy practices with Customers.

13. Third-party services

The Services may link to or integrate with third-party services (payments, maps, messaging, etc.). We are not responsible for third-party services, and your use may be governed by their terms.

14. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, Greater Cater DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, Greater Cater DOES NOT WARRANT THAT ANY RESTAURANT IS LEGITIMATE, LICENSED, PERMITTED, INSURED, OR COMPLIANT WITH APPLICABLE LAW; THAT LISTINGS ARE ACCURATE OR COMPLETE; OR THAT ORDERS WILL BE FULFILLED SAFELY OR ON TIME. ANY RELIANCE ON PLATFORM CONTENT OR TOOLS IS AT YOUR OWN RISK.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Greater Cater WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Greater Cater’S TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID Greater Cater (IF ANY) IN THAT PERIOD.

16. Arbitration agreement and class action waiver (US)

Please read carefully. You and Greater Cater agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, and not in court, except that either party may bring an individual claim in small claims court if eligible.

Opt-out: You may opt out of arbitration within 30 days of first accepting these Terms by emailing us at the contact address below with your name and the email/phone associated with your account and a clear statement that you opt out of arbitration.

17. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except that the arbitration agreement is governed by the Federal Arbitration Act.

18. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date and may require you to accept the revised Terms before continuing to use the Services.
